The Buyer must return the goods to the Seller within 14 (fourteen) days from the moment the Buyer notifies the Seller of the right of withdrawal.
The Buyer is not responsible for any changes or deterioration that occur if the goods are used in accordance with their operation, technical specifications, and usage instructions within the withdrawal period.
As long as the Buyer sends the goods to be returned to the Seller with the Seller's contracted cargo company specified in the pre-information form, the return shipping cost belongs to the Seller. If there is no branch of the Seller's contracted cargo company at the Buyer's location for the return, the Buyer may send it with any cargo company, in which case the shipping cost belongs to the Buyer. If the Buyer sends the goods to be returned with a cargo company other than the Seller's contracted cargo company specified in the pre-information form, the Seller is not responsible for the return shipping cost and any damage the goods may incur during the shipping process.
If an invoice was sent with the goods, the Buyer must fill in and sign the relevant return section and deliver it to the cargo company. In accordance with the General Communiqué on Tax Procedure Law No. 385, for return transactions to be made, the relevant sections on the invoice with a return section must be filled in completely and signed, and then sent back to the Seller with the product.
Upon exercising the right of withdrawal, the Contract between the Buyer and the Seller, as well as ancillary contracts, terminate without any obligation to pay expenses, compensation, or penalty clauses, provided that special provisions are reserved.
In the situations specified below, the Buyer cannot exercise the right of withdrawal:
Contracts related to goods or services whose price fluctuates depending on financial markets and is beyond the control of the seller or provider.
Contracts related to goods prepared in line with the consumer's wishes or personal needs.
Contracts related to the delivery of goods whose protective elements such as packaging, tape, seal, or package have been opened after delivery; and whose return is not suitable for health and hygiene reasons.
Contracts related to goods that are mixed with other products after delivery and cannot be separated due to their nature.
Contracts related to services that have begun to be performed with the consumer's consent before the end of the right of withdrawal period.
Furthermore, the right of withdrawal must be exercised in accordance with the principle of good faith stated in Article 2 of the Turkish Civil Code. In cases where the exercise of the right of withdrawal would constitute an abuse of right, the Buyer cannot exercise the right of withdrawal.
In addition, the Buyer cannot exercise the right of withdrawal for goods and services excluded from the Distance Contracts Regulation and the Law on Consumer Protection.
